About Both Meetings
December 10th: TeraWulf is appealing the Coding Enforcement Officer’s interpretation of town zoning, by trying to classify their AI data center as a "Scientific Research Facility,” a "Warehouse," or “General Processing."
December 16th: Public hearings will be the chance for the public to express our opposition to their zoning appeals.
We need to make our voices heard that we do not think the ZBA should accept Terawulf's appeals.
The classification of a large scale AI data center as a "scientific research facility" is one of the most unfounded claims we have heard from TeraWulf to date.
Terawulf has admitted at their Open Houses that they don't know/care/ask what their clients do with the GPU’s in their facility. TeraWulf classifies themself as an energy infrastructure company, and stated that other companies determine what the computing power is used for. How can TeraWulf consider their AI data center a research facility if they can’t even control what their GPUs are used for?
The Coding Enforcement Officer’s definitions of data centers, laboratories, etc. also does not permit TeraWulf’s AI data center to be classified as a scientific research facility or laboratory.
The classification of a “General Processing" and/or "Warehouse/Storage of non-agricultural goods” doesn’t fit for the data center either.
The Coding Enforcement Officer (CEO) accurately interpreted that TeraWulf’s data center is not a warehouse under terms defined by NYS Building Codes or dictionary definitions (dictionary definitions are used when definitions are not present in zoning and there is no precedent to use as guidance).
The CEO also cited that according to §270-8, uses not listed as permitted are not allowed. Therefore, the data center would not be permitted in the IR zoning district where TeraWulf wants to build.
Now is the time to show your opposition and make your voice heard.
We cannot sit idly while TeraWulf makes their way towards a site plan approval. TeraWulf’s appeals contain flaws that we should point out in public comments on December 16th. It’s important to have a large presence at both meetings to support the Coding Enforcement Officer’s zoning interpretations.
Show up on December 10th and 16th. Wear red and make a public comment at the public hearings on the 16th.
